Appeals Court Upholds Ban on Apple Watch Imports

Prevents sales that include pulse ox technology in the U.S. during ongoing technology litigation versus Masimo.

The U.S. Court of Appeals for the Federal Circuit ruled that the import ban on Apple smartwatches must be upheld while the lawsuit between Apple and medical tech company Masimo proceeds. 

Masimo sued Apple last year, claiming that the company intentionally hired employees from their company to steal their blood oxygen monitoring technology for their latest Apple Watch release. Though the formal legal battle is ongoing, the International Trade Commission ruled in Masimo’s favor in October, banning imports of Series 9 and Ultra 2 Apple Watches for patent infringement of its pulse oximetry technology.  

Apple Watches without the pulse oximeter feature are still available for sale in the United States.
